A BILL to amend article two, chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section nineteen, relating to requiring carbon monoxide detectors in all school buildings; legislative findings; state board and fire marshal to propose legislative rules; device requirements; and state board to file report with legislative oversight commission on educational accountability.

Be it enacted by the Legislature of West Virginia:

That article two, chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section nineteen, to read as follows:

ARTICLE 2. STATE BOARD OF EDUCATION.

§18-2-19. Carbon monoxide detectors in schools; findings; proposal of legislative rules; device requirements; state board to file report.

(a) The Legislature hereby finds there is compelling scientific, health and safety data concerning risks associated with exposure to carbon monoxide gas. Further, there are compelling reasons to believe it is in the best public interest of students, teachers, administrators, and school service personnel and any other persons authorized to be on the premises of school buildings in this state to be protected from the accidental exposure to carbon monoxide.
(b) On or before the first day of July, two thousand one, the state board of education and the office of the state fire marshal shall jointly propose legislative rules, in accordance with the provisions of article three, chapter twenty-nine-a of this code, concerning the installation, placement and use of carbon monoxide warning devices in all school buildings under the authority of the board.
(c) The devices shall emit an audible warning at a decibel level sufficient to alert occupants of dangerous concentrations of carbon monoxide. Additionally, the devices shall be equipped with a visible strobe light to alert individuals that may be hearing impaired.
(d) The state board of education shall file a report concerning the progress made toward compliance with the requirements of this section to the legislative oversight commission on educational accountability on or before the first day of January, two thousand two.


NOTE: The purpose of this bill is to require the placement of carbon monoxide detectors in schools.
