A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §22-5-11a, relating to required notices for air quality permits prior to the permit being granted.

Be it enacted by the Legislature of West Virginia:


ARTICLE 5. AIR POLLUTION CONTROL.

§22-5-11a. Notice required prior to the issuance of an air quality permit.

Prior to the approval of an air quality permit, the following forms of notice shall be given to the public:

(1) All print advertisements must contain the entire application in 12 point font in the newspaper;

(2) The public must be notified through any social media accounts used by the applicant;

(3) The application must be posted on the applicant’s website; and

(4) The Department of Environmental Protection must post the application on its own website.


 

NOTE: The purpose of this bill is to require specific forms of notice to the public before an air quality permit may be issued.
