A BILL to amend and reenact section twenty-three, article five, chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, relating to providing dental clinics in public schools; exempting classroom teachers from providing dental services.

Be it enacted by the Legislature of West Virginia:
That section twenty-three, article five, chapter eighteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended and reenacted to read as follows:
ARTICLE 5. COUNTY BOARD OF EDUCATION.

§18-5-23. Dental clinics and treatment.

The board of education in any school district or independent school district may, in its discretion, establish and maintain dental clinics or courses for teaching mouth hygiene; and may provide for and furnish treatment, if requested by the parent or guardian or deemed considered necessary by the board of education, of children who have defective teeth or mouth conditions, and who shall be found by such board of education, or persons deputized for that purpose, to be unable otherwise to procure such treatment: Provided, That no classroom teacher, as defined in section one, article one, chapter eighteen-a of this code, may be required to provide any services or treatment pursuant to the provisions of this section. Any expense incurred in connection therewith shall be paid out of the maintenance building fund of said district.


NOTE: The purpose of this bill is to exempt public classroom teachers from being required to perform dental treatment services for students if boards of education provide dental clinics or dental treatment in public schools.
