A BILL to amend the Code of West Virginia,1931, as amended, by adding thereto a new section, designated §6-7-2b, relating to allowing a current state employee who is appointed to a position with a statutory set salary to retain their current salary if higher and to retain all of their accrued benefits.

Be it enacted by the Legislature of West Virginia:


ARTICLE 7. COMPENSATION AND ALLOWANCES.


§6-7-2b. Retention of salary and accrued benefits of certain appointive state officers.

Whenever a current state employee is appointed to a position for which the salary is set by this code and the employee currently is paid a higher salary and has accrued benefits from his or her previous state employment, the appointee is entitled to retain the higher salary and all of the accrued benefits when he or she accepts the appointive office. Accrued benefits include, but are not limited to, seniority, sick leave and annual leave.

 

 

NOTE: The purpose of this bill is to allow current state employees who are appointed to a state office which has a salary set by the code to retain their higher salary and accrued benefits.
