A BILL to repeal §31A-2-4c of the Code of West Virginia, 1931, as amended; to repeal §38-1-8a of said code; and to repeal §44-13-4a of said code, relating to repealing provisions requiring the filing of certain reports by trustees for property conveyed that is occupied, or intended to be occupied as a residence by the grantor; and repealing provisions requiring compiling and maintaining of information relating to certain deeds of trusts by county clerks and the West Virginia Housing Development Fund.

Be it enacted by the Legislature of West Virginia:


CHAPTER 31A.  BANKS AND BANKING.

ARTICLE 2.  DIVISION OF BANKING.

§1. Repeal of section requiring certain trustees to file certain reports with the West Virginia Housing Development Fund.

§31A-2-4c of the Code of West Virginia, 1931 as amended, is hereby repealed.

CHAPTER 38.  LIENS.

ARTICLE 1.  VENDOR'S AND TRUST DEED LIENS.


§2. Repeal of section requiring certain trustees to file certain reports with county clerks.

§38-1-8a of the Code of West Virginia, 1931 as amended, is hereby repealed.

CHAPTER 44.  ADMINISTRATION OF ESTATES AND TRUSTS.

ARTICLE 13.  POWERS AND DUTIES OF CLERKS OF COUNTY COURTS IN COUNTIES HAVING SEPARATE TRIBUNAL FOR POLICE AND FISCAL PURPOSES.


§3. Repeal of section requiring county clerks to file foreclosure statistics with the West Virginia Housing Development Fund.

§44-13-4a of the Code of West Virginia, 1931 as amended, is hereby repealed.

 

NOTE: The purpose of this bill is to repeal certain provisions requiring the filing of reports, by trustees relating to deeds of trusts for property conveyed that is occupied, or intended to be occupied as a residence by the grantor. The bill also repeals provisions requiring the compiling and maintaining of information relating to certain deeds of trusts by county clerks and the West Virginia Housing Development Fund.
