A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §18C-1-6, relating to
the recision of state-supported financial aid under certain
circumstances; requiring legislative rule; and authorizing
release of certain information.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §18C-1-6, to read as
follows:
ARTICLE 1. FINANCIAL ASSISTANCE GENERALLY.
§18C-1-6. Recision of state financial aid for certain violations
pertaining to illegal use of alcohol or drugs.
(a) A student receiving any form of state-supported financial
aid, including, but not limited to, the PROMISE scholarship and other programs established in this chapter, shall lose that
financial aid upon conviction of two or more violations within a
five-year period of a state law or municipal ordinance which
pertains to illegal possession or consumption of alcohol,
possession of illegal narcotics or illegal possession of
prescription drugs. These violations include, but are not limited
to, driving under the influence, public intoxication, contributing
to the delinquency of a minor or illegal possession of drugs.
(b) The commission shall propose a rule for legislative
approval in accordance with the provisions of section six, article
one of this chapter and article three-a, chapter twenty-nine of
this code to implement the provisions of this section. Any agency
or jurisdiction which has possession of records which are necessary
for the implementation of this section is authorized to provide
this information to the commission as requested.
(c) This section pertains to citations received on and after
July 1, 2009.
