A BILL to amend article twelve, chapter sixty-two of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section twenty-five, relating to creating a special revenue account designated the parole supervision benefit fund.

Be it enacted by the Legislature of West Virginia:
That article twelve, chapter sixty-two of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section twenty-five, to read as follows:
ARTICLE 12. PROBATION AND PAROLE.
§62-12-25. Parole supervision benefit fund.
(a) There is created a special revenue account in the state treasury designated the "parole supervision benefit fund." Moneys received by any division of corrections personnel for deposit in the parole supervision benefit fund shall be deposited with the state treasurer to be credited to the fund. The fund is to be used by the division of corrections on behalf of its parole services section for the benefit of parolee supervision. Moneys in the fund may be expended with approval of the commissioner of the division of corrections. Moneys to be deposited into the fund may consist of:
(1) Funds donated by the general public or an organization dedicated to parole supervision improvement; and
(2) Funds confiscated and considered contraband due to their illegal use or receipt by parolees as determined by a court of record to include funds confiscated as a part of any multi-jurisdictional crime task force investigation or any division of corrections investigation.
(b) The fund may be used to supplement or offset, or both, the expenses associated with parole supervision or treatment services. The determination of the appropriateness of use of funds rests with the commissioner of the division of corrections or his or her designee.



NOTE: The purpose of this bill is to create a special revenue account designated the Parole Supervision Benefit fund. The fund is to be used by the Division of Corrections on behalf of its Parole Services Section.
