A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §7-1-16, relating to authorizing counties to create urban growth boundaries; definition; and providing for implementation of zoning within these boundaries.

Be it enacted by the Legislature of West Virginia:

    That the Code of West Virginia, 1931, as amended, be amended, by adding thereto a new section, designated §7-1-16, to read as follows:

ARTICLE 1. COUNTY COMMISSIONS GENERALLY.

§7-1-16. Authority to designate urban growth boundaries; implementation of zoning within urban growth boundaries.

    In addition to all other powers now conferred by law upon county commissions, the commissions may establish urban growth boundaries and may implement zoning requirements only within the urban growth boundaries.

    For the purposes of this section, the term “urban growth boundary” means a regional boundary set to control urban growth allowing the area inside the boundary for higher density urban growth and the area outside for lower density growth development with regard to water and sewer services. It includes the use by county commissions to guide zoning and land use decisions inside and outside the boundaries.




    NOTE: The purpose of this bill is to authorize county commissions to create urban growth boundaries. The bill provides a definition of “Urban Growth Boundary” and provides for implementation of zoning within these boundaries.
