A BILL to amend the code of West Virginia, 1931, as amended, by
adding thereto a new article, designated §21-14-1 and
§21-14-2, all relating to requiring retail establishments to
have bathroom facilities on the premises for use by members of
the general public.
Be it enacted by the Legislature of West Virginia:
That the code of West Virginia, 1931, as amended, be amended
by adding thereto a new article, designated §21-14-1 and §21-14-2,
all to read as follows:
ARTICLE 14. RETAIL STORE PUBLIC FACILITIES ACT.
The Legislature finds that it is necessary to the safety,
health, public interest and general welfare of the people of the State of West Virginia that retail stores operating in the State be
equipped with public bathroom facilities.
§21-14-2. All retail stores to be furnished with public bathroom
(a) For the purposes of this article, "retail store" means any
commercial establishment in which consumer goods or services are
sold to members of the general public and in which gross annual
receipts from these sales exceed two hundred thousand dollars.
(b) Effective the fifth day of June, two thousand seven, all
retail stores, as defined by subsection (a) of this section, doing
business in this State, shall keep and maintain public bathroom

legislative approval in accordance with article three, chapter
