A BILL to amend and reenact §17C-8-5 of the Code of West Virginia, 1931, as amended, relating to requiring property owners to keep property adjacent to intersection clear of obstacles for line of sight of operators of motor vehicles.

Be it enacted by the Legislature of West Virginia:
That §17C-8-5 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:
ARTICLE 8. TURNING AND STARTING AND SIGNALS ON STOPPING AND TURNING.

§17C-8-5. Local authorities may specify different course for turns; and require adjacent property be kept clear of obstacles to sight of drivers.

(a) Local authorities in their respective jurisdictions may cause markers, buttons, or signs to be placed within or adjacent to intersections and thereby require and direct that a different course from that specified in this article be traveled by vehicles turning at an intersection, and when markers, buttons or signs are so placed no driver of a vehicle shall turn a vehicle at an intersection other than as directed and required by such markers, buttons, or signs.
(b) Local authorities in their respective jurisdictions shall require property owners to keep property adjacent to intersections clear of obstacles for the line of sight of operators of motor vehicles for up to one hundred feet.



NOTE: The purpose of this bill is to require property owners to keep property adjacent to intersections clear of obstacles for line of sight of operators of motor vehicles for up to 100 feet.
