A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §17C-15-51, relating to devices on motor vehicles.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §17C-15-51, to read as follows:
ARTICLE 15. EQUIPMENT.
§17C-15-51. Voluntary installation of interlock device.
(a) Any owner of a vehicle in West Virginia that is duly registered and in compliance with applicable regulations under this code, may choose to install an interlock device on their vehicle without approval of the Division of Motor Vehicles.
(b) All interlock systems must be installed by a private carrier and information concerning any such installation shall not be made available or sent to the Division of Motor Vehicles.
In order to insure confidentiality of the information to the private owner of the vehicle with the voluntary interlock system, the carrier who performs the installation of the system must not be the same one that is contracted for the Division of Motor Vehicles Program.
(c) Insurance companies shall take into consideration the installation of an interlock system when determining rates for insuring the vehicle for a reduction in the rate of the vehicle owner's insurance premium. The Insurance Commission shall propose rules for legislative approval in accordance with the provisions of article three, chapter twenty-nine-a.


NOTE: The purpose of this bill is to permit private owners of vehicles to install an interlock system on their vehicle.
