A BILL to amend article six, chapter eight of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section one-a, relating to notice of intention to annex; and written notice by certified mail to each freeholder of land in the area to be annexed.

Be it enacted by the Legislature of West Virginia:

That article six, chapter eight of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section one-a, to read as follows:

ARTICLE 8. ANNEXATION.

§8-6-1a. Notice of annexation required; contents of notice.

For any intended annexation, whether by election, without an election or by minor boundary adjustment, the annexing municipality, in addition to all other notices required under this article, shall cause each and every freeholder of land lying in the area to be annexed to be served, by certified mail, of a notice of the municipality's intention to annex and the date, time and place of any and all events essential to that annexation.



NOTE: The purpose of this bill is to assure that each freeholder of land situate in an area sought to be annexed will have notice of the fact of the intended annexation and the day, time and place of events important to that process.
