A BILL to amend article five, chapter nine of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section twelve-a, relating to extending Medicaid coverage to low income West Virginia women who have been diagnosed with breast or cervical cancer.

Be it enacted by the Legislature of West Virginia:
That article five, chapter nine of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section twelve-a, to read as follows:
ARTICLE 5. MISCELLANEOUS PROVISIONS.

§9-5-12a. Medicaid program; breast and cervical cancer treatment.
(a) A woman who:
(1) Is not eligible for Medicaid under any other provision of this chapter;
(2) Is less than sixty-five years of age;
(3) Has been:
(A) Screened for breast or cervical cancer through the breast and cervical cancer screening program under the federal Breast and Cervical Cancer Mortality Prevention Act of 1990 (42 U.S.C. 300k); and
(B) Determined to need treatment for breast or cervical cancer; and
(4) Is not otherwise covered under credible coverage as defined in 42 U.S.C. 300gg(c); is eligible for Medicaid.
(b) Medicaid made available to a woman described in subsection (a) is limited to:
(1) Medical assistance for services required for treatment of breast or cervical cancer; and
(2) The duration of treatment required for breast or cervical cancer.
(c) The division may apply a resource standard not to exceed the resource standard applied to a pregnant woman under section twelve of this article in determining the eligibility of a woman described in subsection (a).



NOTE: The purpose of this bill is to extend Medicaid coverage to low income West Virginia women who have been diagnosed with breast or cervical cancer.
