A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new article, designated §9-4F-1, §9-4F-2 and §9-4F-3, all relating to creating the Medicaid Laboratory Reimbursement Data Consolidation and Redundancy Act within the Department of Health and Human Resources; and providing that a reporting system is to be created allowing pharmacies to determine what prescriptions have been filled for a Medicaid recipient  at different pharmacies; providing that the system also track laboratory work; and requiring legislative rules.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended, by adding thereto a new article, designated §9-4F-1, §9-4F-2 and §9-4F-3, all to read as follows:

ARTICLE 4F. MEDICAID Laboratory Reimbursement Data Consolidation and Redundancy Act MONITORING.


§9-4F-1. Short title.

This article shall be referred to as the West Virginia Medicaid Laboratory Reimbursement Data Consolidation and Redundancy Act.


§9-4F-2. Establishment of program; purpose.

There is hereby established within the Department of Health and Human Resources a West Virginia Medicaid Laboratory Reimbursement Data Consolidation and Redundancy Act, the purpose of which is to require the recordation and retention in a single repository of information regarding: (a) The prescribing, dispensing and consumption of certain medications or controlled substances by one pharmacy to Medicaid recipients in order that another pharmacy can review what has been prescribed for these recipients by a physician or dentist; and (b) the prescribing of laboratory work performed at the request of one physician or dentist when the patient must see a different physician or dentist for continued treatment or different treatment in order that each physician or dentist can review the various laboratory tests that have been conducted on the patient.


§9-4F-3. Promulgation of rules.

The Secretary of the Department of Health and Human Resources shall propose rules for legislative approval rules in accordance with article three, chapter twenty-nine-a of this code to effectuate the purposes of this article.


 

NOTE: The purpose of this bill is to create the Medicaid Laboratory Reimbursement Data Consolidation and Redundancy Act within the Department of Health and Human Resources. The bill requires that a reporting system is to be created that will allow pharmacies to determine what prescriptions have been filled for a Medicaid recipient at different pharmacies.  The bill also provides that the system track laboratory work.
