A BILL to repeal §62-12-12, §62-12-12a, §62-12-13, §62-12-13a, §62-12-14a, §62-12-15, §62-12-17, §62-12-18, §62-12-19, §62-12-21, §62-12-23, §62-12-24 and §62-12-25 of the Code of West Virginia, 1931, as amended; and to amend and reenact §62-12-14, relating to eliminating parole for persons incarcerated in state correctional facilities.

Be it enacted by the Legislature of West Virginia:
That §62-12-12, §62-12-12a, §62-12-13, §62-12-13a, §62-12-14a, §62-12-15, §62-12-17, §62-12-18, §62-12-19, §62-12-21, §62-12-23, §62-12-24 and §62-12-25 of the Code of West Virginia, 1931, as amended, be repealed; and that §62-12-14 of said code be amended and reenacted to read as follows:
ARTICLE 12. PROBATION AND PAROLE.
§62-12-14. Appointment of probation and parole officers and clerical assistants; qualifications of officers; salaries and expenses; disposition of Parole Supervision Benefit Fund.

The director shall have authority to appoint such state probation and parole officers as may be necessary to the proper administration of this article, and to employ clerical assistants. He or she shall determine the qualifications of probation and parole officers and may from time to time conduct competitive examinations as a basis for their selection.
The director shall fix the salaries of state probation and parole officers and all clerical assistants. All persons appointed or employed by the director shall be paid all necessary expenses incurred in the discharge of their duties.
Any funds remaining in the Parole Supervision Benefit Fund created by section twenty-five, article twelve, chapter sixty-two shall be used by the Division of Corrections for matters relating to probation officers with approval of the Commissioner.



NOTE: The purpose of this bill is to eliminate parole for persons incarcerated in state correctional facilities.
