A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §5A-3-56a, relating to purchasing; and prohibiting certain public works contracts unless the vendor can demonstrate that it offers health insurance coverage to its employees and pays at least seventy-five percent of the cost therefor.

Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §5A-3-56a, to read as follows:

ARTICLE 3. PURCHASING DIVISION.

§5A-3-56a. Requirement for public works contracts.

Notwithstanding any provision of this code to the contrary, no vendor may bid on or be awarded a public works contract with the state or any of its political subdivisions in a total amount of twenty-five thousand dollars or more unless the vendor establishes to the director's satisfaction that the vendor offers its employees a policy of health care insurance that is at least equivalent to
the benefits and coverage provided under the insurance plan established in section sixteen, article sixteen-d, chapter thirty-three of this code and the vendor demonstrates that it pays at least seventy-five percent of the cost of such coverage.



NOTE: The purpose of this bill is to prohibit public contracts with vendors unless they can demonstrate that they offer health care insurance to their employees and pay at least 75% of the cost of such insurance coverage.
