A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §20-2-5f, relating to
the creation of a criminal offense for any person to knowingly
hunt, kill, trap, ensnare, destroy or attempt to destroy an
albino deer; establishing fines and penalties for such
violations.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §20-2-5f, to read as
follows:
ARTICLE 2. WILDLIFE RESOURCES.
§20-2-2f. Albino deer.
(a) Except as provided in section fifteen, article two,
chapter twenty of this Code, it is unlawful for any person to
knowingly hunt, take, kill, trap, ensnare, destroy, attempt to
destroy, or to have in such person's possession albino deer, which
is a deer with a lack of significant deficiency of pigment in the
skin and hair and with pink eyes.
(b) Anyone who violates the provisions of this section is
guilty of a misdemeanor, and upon conviction thereof, shall be
fined not less than one hundred dollars nor more than five hundred dollars, or imprisoned in a county or regional jail not less than
ten nor more than one hundred days, or both fined and imprisoned.
NOTE: The purpose of this bill is to make it a unlawful to
hunt, trap, shoot, destroy, attempt to destroy or possess an albino
deer, and to provide penalties and fines for such violations.
