A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §61-8B-6, relating to creating the offense of sexual battery; and providing a criminal penalty.

Be it enacted by the Legislature of West Virginia:

    That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §61-8B-6, to read as follows:

ARTICLE 8B. SEXUAL OFFENSES.

§61-8B-6. Sexual battery.

    (a) Any person who, without consent, subjects another person to any sexual contact, as defined in section one of this article, is guilty of sexual battery.

    (b) Sexual battery is a misdemeanor punishable by confinement in jail for not more than one year, or a fine of not more than $1,000, or both fined and confined.




    NOTE: The purpose of this bill is to create the offense of sexual battery. The bill provides a criminal penalty.
