A BILL expiring funds to the unappropriated balance in the State Fund, State Excess Lottery Revenue Fund, for the fiscal year ending June 30, 2011 in the amount of $10,000,000 from the Lottery Commission - Revenue Center Construction Fund, fund 7209, organization 0705, and making supplementary appropriation to the Division of Health - Central Office, fund 5219, fiscal year 2011, Organization 0506, by supplementing and amending the appropriation for the fiscal year ending June 30, 2011. by supplementing and amending Chapter 8, Acts of the Legislature, Regular Session, 2010, known as the Budget Bill.

WHEREAS, The Legislature finds that the account balance in the Lottery Commission - Revenue Center Construction Fund, fund 7209, organization 0705 exceeds that which is necessary for the purposes for which the account was established; and
WHEREAS, The Governor submitted to the Legislature the Executive Budget Document, dated January 12, 2011, containing a Statement of the State Excess Lottery Revenue Fund, setting forth therein the cash balance as of the first day of July 1, 2010, and further included the estimate of revenue for the fiscal year 2011, less regular appropriations for the fiscal year 2011; and
WHEREAS, It appears from the Governor's Statement of the State Excess Lottery Revenue Fund there now remains an unappropriated balance in the State Treasury which is available for appropriation during the fiscal year ending June 30, 2011; therefore
Be it enacted by the Legislature of West Virginia:

That the balance of the funds available to the Lottery Commission - Revenue Center Construction Fund, fund 7209, organization 0705, be decreased by expiring the amount of $10,000,000 to the unappropriated balance of the State Fund, Excess Lottery, to be available for appropriation during the fiscal year 2011.
And, That the total appropriation for the fiscal year ending June 30, 2011, to fund 7208, fiscal year 2011, organization 0705, be supplemented and amended to hereafter read as follows:

Any unexpended balance remaining in the appropriation for Capital Outlay and Maintenance (fund 5219, activity 755) at the close of fiscal year 2010 is hereby reappropriated for expenditure during the fiscal year 2011, and any unexpended balance remaining in the appropriation for Unclassified (fund 5219, activity 099) at the close of fiscal year 2011 is hereby reappropriated for expenditure during the fiscal year 2012.
The above appropriation for Unclassified is hereby appropriated to provide grants for the sole and exclusive purposes of substance abuse prevention, intervention, treatment and recovery consistent with the findings of "The Governor's Comprehensive Strategic Plan to Address Substance Abuse in West Virginia" and the recommendations of the Partnership to Promote Community Well-Being. The grants shall be allocated by the Division in accordance with data-based criteria to be developed by the Division, and priority consideration shall be given to unserved and under-served areas of the State. The Division shall administer the grants and collect data measuring their effectiveness.
The purpose of this bill is to expire funds into the unappropriated balance in the State Fund, Excess Lottery, and to supplement, amend, and add an item of appropriation in the aforesaid account for the designated spending unit for expenditure during the fiscal year 2011.
