A BILL to amend and reenact §64-9-1 of the Code of West Virginia, 1931, as amended, relating to authorizing the Real Estate Commission to promulgate a legislative rule relating to requirements for real estate courses, course providers and instructors.

Be it enacted by the Legislature of West Virginia:


ARTICLE 9. Authorization for MISCELLANEOUS AGENCIES AND BOARDS to promulgate legislative rules.

§64-9-1. Real Estate Commission.

The legislative rule filed in the State Register on July 27, 2017, authorized under the authority of §30-40-8 of this code, modified by the Real Estate Commission to meet the objections of the Legislative Rule-making Review Committee and refiled in the State Register on December 6, 2017, relating to the Real Estate Commission (requirements for real estate courses, course providers and instructors, 174 CSR 3), is authorized with the amendments set forth below:

On page 6, subsection 3.9. to read as follows:

3.9. All approved pre-license and continuing education instructors shall complete annual instructor development workshops when offered by the Commission, unless the attendance is waived by the Commission or the individual is an out-of-state instructor who a) is approved by the National Association of Realtors (NAR) or b) holds a Distinguished Real Estate Instructor (DREI) designation.

 

NOTE: The purpose of this bill is to authorize the Real Estate Commission to promulgate a legislative rule relating to requirements for real estate courses, course providers and instructors.
