A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §5A-3-49a, relating to prohibiting certain persons from operating state-owned vehicles; and rulemaking.

Be it enacted by the Legislature of West Virginia:

ARTICLE 3. PURCHASING DIVISION.


5A-3-49a. Prohibiting certain persons from operating state-owned vehicles.

(a) No person may operate a vehicle owned or possessed by the State of West Virginia for five years following a conviction for an offense described in §17C-5-2 of this code or had a period of conditional probation imposed pursuant to §17C-5-2b of this code, or for an offense described in a municipal ordinance which has the same elements as an offense described in said sections.

(b) This prohibition remains in effect for five years notwithstanding the person’s possession of a valid license to operate a motor vehicle.

(c) The Secretary of Administration shall promulgate rules relating to the regular verification that persons who operate state-owned vehicles possess a valid driver’s license and are not prohibited by section (a) from the operation of a state-owned vehicle.

 

NOTE: The purpose of this bill is to prohibit persons from operating state-owned vehicles for five years, if they are convicted for an offense described in §17C-5-2 of this code or had a period of conditional probation imposed pursuant to §17C-5-2b of this code.
