A BILL to amend and reenact §17C-14-1 of the Code of West Virginia, 1931, as amended, relating to unattended motor vehicles; misdemeanor penalty; and providing that a motor vehicle that has been started by use of a remote starter when the vehicle is locked is not an unattended vehicle and not in violation of this section.

Be it enacted by the Legislature of West Virginia:

    That §17C-14-1 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:

ARTICLE 14. MISCELLANEOUS RULES.

§17C-14-1. Unattended motor vehicle; penalty.

    (a) No person driving or in charge of a motor vehicle shall may permit it to stand unattended without first stopping the engine, locking the ignition, removing the key, and effectively setting the brake thereon and, when standing upon any grade, turning the front wheels to the curb or side of the highway: Provided, That a motor vehicle that has been started by use of a remote starter when the vehicle is locked is not an unattended vehicle within the meaning of this section and therefore not a violation of this section.

    (b) Any person violating the provisions of this section is guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than $100; upon a second conviction within one year thereafter, shall be fined not more than $200; and upon a third or subsequent conviction, shall be fined not more than $500.

 

 

    NOTE: The purpose of this bill is to provide that a motor vehicle that has been started by use of a remote starter when the vehicle is locked is not an unattended vehicle and not in violation of this section.
