A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §52-1-27; and to amend said code by adding thereto a new section, designated §52-2-17, all relating to certain persons who have been disqualified or excused from jury service.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §52-1-27; and that said code be amended by adding thereto a new section, designated §52-2-17, all to read as follows:

ARTICLE 1. PETIT JURIES.


§52-1-27. Provisions applying to persons excused or disqualified for nonresidency.

Whenever any person is disqualified from or excused from jury service as a result of that person not being a resident within the county they were presumed to have resided, the court shall provide notice to the clerk of the county commission of the county the juror was believed to have resided and the office of the Secretary of State, and the person shall be removed from the list of voters maintained by those offices in accordance with the provisions of 42 U. S. C. §1973gg, et seq., the National Voter Registration Act of 1993.

ARTICLE 2. GRAND JURIES.


§52-2-17. Provisions applying to persons excused or disqualified for nonresidency.

Whenever any person is disqualified from or excused from jury service as a result of that person not being a resident within the county they were presumed to have resided, the court shall provide notice to the clerk of the county commission of the county the juror was believed to have resided and the office of the Secretary of State, and the person shall be removed from the list of voters maintained by those offices in accordance with the provisions of 42 U. S. C. §1973gg, et seq., the National Voter Registration Act of 1993.

NOTE: The purpose of this bill is to provide for the removal of certain persons, who have been disqualified or excused from jury service on the grounds of nonresidence, from the voter registration rolls.
