A BILL to amend article three, chapter five of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section two-b,
relating to authorizing the attorney general to investigate
and prosecute crimes occurring in more than one jurisdiction
in West Virginia.
Be it enacted by the Legislature of West Virginia:
That article three, chapter five of the code of West Virginia,
one thousand nine hundred thirty-one, as amended, be amended by
adding thereto a new section, designated section two-b, to read as
follows:
ARTICLE 3. ATTORNEY GENERAL.
§5-3-2b. Prosecution of offenses committed in multiple jurisdictions.
The attorney general may investigate and prosecute on behalf
of the state any criminal offense which is committed partly in one
county within this state and partly in one or more other counties,
states or countries, or any offense committed or made punishable
within this state which is part of a common scheme or plan
encompassing multiple crimes committed in more than one county,
state or country, in accordance with the rules and procedures
attendant to criminal prosecutions generally. Law enforcement
agencies shall provide assistance required by the attorney general
for this purpose.
NOTE: The purpose of this bill is to
authorize the attorney
general to investigate and prosecute crimes occurring in more than
one jurisdiction in West Virginia.
