A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new article, designated §22-29-1, relating to
the control of noise pollution.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new article, designated §22-29-1, to read as
follows:
ARTICLE 29. NOISE POLLUTION MITIGATION.
§22-29-1. Construction noise pollution.
All contractors, subcontractors, independent contractors, and
any individual performing work at a construction site, whether
within an incorporated or unincorporated area, shall take
sufficient measures to mitigate noise pollution to ensure the quiet
enjoyment of property owners in the vicinity of the construction
project.
NOTE: The purpose of this bill is to provide for mitigation of
construction noise by the Department of Environmental Protection.
