A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §15-3A-8, relating to
registration of state-owned or leased cellular phones and
mobile communication devices with the national Wireless Amber
Alert Initiative.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §15-3A-8, to read as
follows:
ARTICLE 3A. AMBER ALERT PLAN.
§15-3A-8. Registration of state owned cellular phones and mobile
communication devices.
Cognizant of the statistics showing that the first three hours
after a child's abduction are most critical to recovery efforts and
recognizing that wireless technology can help galvanize communities to assist law enforcement in the search for and return of a missing
child, it is thus required that any cellular phone or other mobile
communications device, which is capable of receiving text messages,
and which is owned or leased by the State of West Virginia or any
agency thereof, or, which is otherwise provided to any user using
state funds, shall be registered with the national Wireless Amber
Alert Initiative, a voluntary partnership between the wireless
industry, the United States Department of Justice, and the National
Center for Missing & Exploited Children (NCMEC), which exists to
distribute Amber Alerts to wireless subscribers.
NOTE: The purpose of this bill is to require registration of
state owned cellular phones and mobile communications devices with
the national Wireless Amber Alert Initiative.
