HOUSE CONCURRENT RESOLUTION NO. 163

Requesting the Joint Committee on Government and Finance study the impact of permitting the disposal into commercial solid waste landfills of drill cuttings and associated drilling mud generated from well sites and the adequacy of the provisions of the West Virginia Natural Gas Horizontal Well Control Act of 2011 and the West Virginia Department of Environmental Protection's memoranda to Solid Waste Landfill Owners and Operators of January 11, 2013 and February 21, 2013 respecting the monthly capacity of commercial solid waste disposal landfills to accommodate such wastes.

    Whereas, The Legislature recognizes the importance of our gas and oil drilling industry; and

    Whereas, The Legislature recognizes the need for the safe, efficient and economical disposal of drill cuttings and associated drilling mud generated from gas and oil well sites; and

    Whereas, The Legislature recognizes that our commercial solid waste landfills are a safe and well-regulated means of disposing of a wide variety of solid waste; therefore, be it

    Resolved by the Legislature of West Virginia:

    That the Joint Committee on Government and Finance study the impact of permitting the disposal into commercial solid waste landfills of waste comprised of drill cuttings and associated drilling mud generated from well sites; and, be it

    Further Resolved, That the Committee consider the adequacy of the provisions of the West Virginia Natural Gas Horizontal Well Control Act of 2011 and the West Virginia Department of Environmental Protection's memoranda to Solid Waste Landfill Owners and Operators of January 11, 2013 and February 21, 2013 respecting the monthly capacity of commercial solid waste disposal landfills to accommodate the disposal of drill cuttings and associated drilling mud; and, be it

    Further Resolved, That the committee report to the regular session of the 2014 Legislature its findings, conclusions and recommendations, together with drafts of any proposed legislation necessary to effectuate its recommendations; and, be it

    Further Resolved, That the expenses necessary to conduct this study, to prepare a report and to draft legislation, if any, be paid from legislative appropriations to the Joint Committee on Government and Finance.
