A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §12-4-17, relating to public moneys; and prohibiting payment of same to certain entities.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §12-4-17, to read as follows:
ARTICLE 4. ACCOUNTS, REPORTS AND GENERAL PROVISIONS.

§12-4-17. Payment of public moneys to certain entities prohibited.

(a) Notwithstanding any provision of this code to the contrary, neither the state or any of its political subdivisions may pay any public moneys to a person or entity which has in the twelve months preceding awarded management bonuses or pay raises to managerial personnel and either temporarily or permanently laid off hourly employees.
(b) For purposes of this section:
(1) "Public moneys" includes tax rebates and tax credits; and
(2) "Management bonuses or pay raises" include stock options and any other thing of value.



NOTE: The purpose of this bill is to prohibit the payment of public moneys to persons or entities that have awarded management bonuses or pay raises in the last 12 months while at the same time laying off hourly employees.
