A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §5-1B-4a, relating to requiring the Chief Technology Officer to maintain a central cross index of forms used by state agencies; definitions; and additional powers and duties of the Chief Technology Officer.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §5-1B-4a, to read as follows:
ARTICLE 1B. CHIEF TECHNOLOGY OFFICER.
§5-1B-4a. Cross index for State Agency forms; definitions; additional powers and duties of the Chief Technology Officer.

(a) Unless the context clearly requires a different meaning, as used in this section:
(1) "Agency" means any State executive office, department, division, agency, board, bureau, commission or institution, but does not include those in the legislative or judicial branch of State government, those existing pursuant to chapter eighteen, eighteen-a or eighteen-b of this code or any county, city, municipal corporation, township, public service district or other political subdivision of the State;
(2) "Form" means every piece of paper, transparent plate or film containing information, printed, generated or reproduced by whatever means with blank spaces left for the entry of additional information to be used in any transaction involving an agency.
(b) The Chief Technology Officer shall maintain a central cross index repository of agency forms to promote and provide a central source of agency forms for common use and availability. Agencies shall provide, at the request of the Chief Technology Officer, agency forms which the Chief Technology Officer determines necessary to meet the requirements of this section.
(c) The Chief Technology Officer may:
(1) Study, develop and establish a program for the coordination between agencies to develop forms for interagency and common administrative use;
(2) Review agency forms for grammar, spelling, clerical and technical correctness and advise agencies of any errors found upon review;
(3) Develop a comprehensive system of numbering and cataloguing of agency forms;
(4) Make recommendations to agencies for the economical and uniform development of forms and recommend measures to avoid undue creation and reproduction of forms;
(5) Establish and develop a program for the availability of agency forms through the use of information systems and information technology, accessible to agencies and the general public, and to cooperate with and seek the assistance of the Director of the Division of Purchasing within the Department of Administration in the development of the program.


NOTE: This bill requires the Chief Technology Officer to maintain a central cross index repository of agency forms for common use and availability and requires agencies to cooperate in the effort. The Chief Technology Officer is authorized to provide other services to assure uniform quality and availability of forms.
