A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §61-3E-3a, relating to requiring anyone who uses any kind of explosive material to make a quarterly inventory and usage report to the State Police which lists when and where such materials were used.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §61-3E-3a, to read as follows:
ARTICLE 3E. OFFENSES INVOLVING EXPLOSIVES.
§61-3E-3a. Quarterly inventory of explosives to be reported to State Police.

Any person or business which uses or possesses any kind of explosive material shall provide the State Police with a quarterly inventory and usage report, stating the amount of such material in inventory as well as where and when such explosive material was used. The reporting requirements of this section do not apply to the purchase of ammonium nitrate by farmers for use as a fertilizer. Such reports are to be made every three months, beginning on the first day of July, two thousand five.



NOTE: The purpose of this bill is to require
anyone who uses any kind of explosive material to make a quarterly inventory and usage report to the State Police which lists when and where such materials were used.
