A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §61-3-58, relating
to making it a crime to knowingly sell an unstable horse.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §61-3-58, to read as
follows:
ARTICLE 3. CRIMES AGAINST PROPERTY.
§61-3-58. Sale of unstable horse.
Any person who, knowingly sells an unstable horse without
notifying the buyer in writing that the horse is unstable,
specifying the horse's dangerous propensities, is guilty of a
misdemeanor and, upon conviction thereof, shall be fined not less
than five hundred dollars or confined in jail not more than sixty
days, or both. For the purposes of this section "unstable horse" means any riding horse which is more than two years old that
exhibits dangerous propensities of which the seller is aware, such
as kicking, biting or lunging, or which has exhibited an unstable
gait on more than three occasions.
NOTE: The purpose of this bill is to make it a crime to
knowingly sell an unstable horse.
