A BILL to amend article one, chapter sixteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding a new section, designated section nine-c; and to amend and reenact section nine, article seventeen, chapter thirty of said code, all relating to requiring the board of registration for sanitarians and the division of environmental health services to notify registered sanitarians and other registered certified or licensed persons prior to expiration of their registration, certification or license.

Be it enacted by the Legislature of West Virginia:
That article one, chapter sixteen of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, section nine-c; and that section nine, article seventeen, chapter thirty of said code be amended and reenacted, to read as follows:
CHAPTER 16. PUBLIC HEALTH

ARTICLE 1. STATE PUBLIC HEALTH SYSTEM.
§16-1-9c. Division of environmental health services to notify persons prior to expiration of licenses or certifications.

At least forty-five days before the license, certification or registration is to expire, the director of the division of environmental health services shall notify by first class mail, each individual licensed, certified or registered under the division of the date the license, certification or registration is to expire, instructions on how to renew, and the consequences of nonrenewal.
CHAPTER 30. PROFESSIONS AND OCCUPATIONS.

ARTICLE 17. SANITARIANS.

§30-17-9. Board organization; duties of the board, officers, compensation, seal and meetings.

(a) The members of the board shall, as soon as appointed, organize and annually thereafter in the month of July, elect from their number a chairperson and vice chairperson.
(b) The board shall make such rules as are necessary to carry out the provisions of this article.
(c) Funds collected under the provisions of this article shall be used exclusively to pay compensation and expenses of the board and to administer the provisions of this article.
(d) The board may at such times as it deems considers necessary employ such administrative employees or other persons as may be necessary to carry out the provisions of this article.
(e) At least forty-five days before the registration is to expire, the board shall notify each registered sanitarian or sanitarian-in-training, by first class mail, of the date the individual's registration will expire, instructions on how to renew the registration, and the consequences of nonrenewal.



NOTE:
The purpose of this bill is to require the Board of Registration for Sanitarians to notify registered sanitarians and sanitarians-in-training prior to expiration of their registration, and inform them of steps necessary to renew registration. It requires the Division of Environmental Health Services to give similar notice to individuals licensed, certified or registered under the division.

§16-1-9c is new; therefore, strike-throughs and underscoring have been omitted.

Strike-throughs indicate language that would be stricken from the present law, and underscoring indicates new language that would be added.
