A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §7-1-3tt, relating to allowing county commissions to set standards for certain road construction projects within their counties.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §7-1-3tt, to read as follows:

ARTICLE 1. COUNTY COMMISSIONS GENERALLY.


§7-1-3tt.  Setting standards for certain road construction projects within the county.

            County commissions may set standards for any road, street or alley construction project in their counties under the following conditions:

(1) The construction project is requested by sixty percent of the owners of land abutting the road, street or alley included in the project;

(2) Sixty percent of the owners of abutting land who will be assessed for the cost of the project agree to the standards after the cost of the project is made known at a public hearing;

(3) The construction project does not currently connect to any roadway included in the state road system; and

(4) The standards for the construction projects are approved by a licensed engineer experienced in road construction.

 

NOTE: The purpose of this bill is to authorize county commissions to set standards for certain road construction projects within their counties.
