A BILL to amend article two, chapter twenty of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section forty-six-n, relating to the creation of a Class QM hunting license for mentally impaired persons.

Be it enacted by the Legislature of West Virginia:
That article two, chapter twenty of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section forty-six-n, to read as follows:
ARTICLE 2. WILDLIFE RESOURCES.
§20-2-46n. Class QM special license for mentally impaired persons.

(a) A Class QM license shall be a special statewide hunting permit and shall be available to any resident who is either:
(1) A person who is eligible for a hunting license according to the provisions of this article but would otherwise be disallowed a license due to a mental impairment: Provided, That no person is eligible for a Class QM license who has been adjudicated to be mentally incompetent; or
(2) A person or their legal guardian may request a Class QM license in lieu of a Class A license.
(b) All fees, requirements, rights and privileges for this license shall be the same as those for a Class A license issued pursuant to section thirty-nine of this article.
(c) When hunting, the permittee must be accompanied and supervised by an adult holder of a current West Virginia certified hunting license other than a Class QM.
(d) A form for such permit shall be furnished by the director to any applicant who meets the above requirements.
