Requesting the West Virginia congressional delegation to encourage the United States Fish and Wildlife Services and the United States Corps of Engineers to grant permits for making improvements to the unimproved segment of Brush Creek in Mercer County.

Whereas, The Brush Creek watershed work plan was prepared in November, 1959, under the authority of the Watershed Protection and Flood Prevention Act (Public Law 566, 83rd Congress, 68 Stat. 666) as amended several times; and
Whereas, The plan was the result of extensive coordination and cooperation among local citizen groups, local state and federal agencies; and
Whereas, Construction of the improved Brush Creek Channel to prevent wide-spread flooding took place over a period of years beginning in 1959; and
Whereas, 2.1 miles of Brush Creek remains unimproved in the Glenwood area (from Green Tree Mobile Home Park to the Glenwood County Store) and causes repeated flooding in the unimproved area and all areas upstream. Residential and business properties in both Glenwood and Green Valley are repeatedly flooded and damaged because the unimproved area blocks the flow of water coming from up-stream forcing residents to be evacuated from their homes; and
Whereas, Residents and businesses in the Glenwood and Green Valley areas have petitioned all appropriate local, state and federal agencies to cooperate and take necessary actions to prevent continued flooding of these areas by making improvements to the unimproved segment of Brush Creek; and
Whereas, Permits for making improvements to this segment of Brush Creek must be granted by the Corps of Engineers and Fish and Wildlife; therefore, be it
Resolved by the Legislature of West Virginia:
That the House of Delegates hereby requests the West Virginia Ccongressional Ddelegation to encourage the United States Corp of Engineers and the United States Fish and Wildlife Services to grant the appropriate permits so that improvements can be made to the unimproved segment of Brush Creek in Mercer County; and, be it
Further Resolved, That the Clerk furnish a copy of this resolution to each member of the West Virginia Ccongressional Ddelegation.
