    Delegate Manchin moves to amend the Finance Committee amendment as follows:

    On page eighty-three, section nine, beginning on line twenty-two and continuing through line eighty-four, line eight, by striking out section nine in its entirety and inserting in lieu thereof the following:

Ҥ22-31-9. Prohibition of general NPDES permits within a Zone of Critical Concern; requiring individual NPDES permit for any site; excepting Construction General Permits.

    Because of the potential public health impact of pollution to downstream public water intakes in a watershed basin designated in an area of critical concern, on and after September 1, 2014, with the exception of a permittee holding authority to discharge stormwater under a Construction General Permit, any permittee which presently holds a National Pollutant Discharge Elimination System (NPDES) general permit pursuant to the Federal Water Pollution Control Act for a site which is located within any public water system’s Zone of Critical Concern must apply for and hold an individual permit under that Act. Any general NPDES permit held currently under that act shall remain in effect until the individual NPDES permit is either issued or denied. On and after July 1, 2016, any entity which is required to seek and obtain an NPDES permit within a defined Zone of Critical Concern for a public water system, other than a Construction General Permit, must obtain an individual NPDES permit for that site location.”
