The House of Delegates met at 11:00 a.m., and was called to order by the Honorable Richard Thompson, Speaker.
Prayer was offered and the House was led in recitation of the Pledge of Allegiance.
The Clerk proceeded to read the Journal of Wednesday, January 16, 2008, being the first order of business, when the further reading thereof was dispensed with and the same approved.
At the request of Delegate DeLong, and by unanimous consent, the applicable provisions of House Rule 136, relating to privileges of the floor, were suspended for the day to extend privileges of the floor to invited guests for a presentation by the House.

Resolutions Introduced

Delegates Morgan, Martin, Argento, Caputo, Eldridge, Hartman, Higgins, D. Poling, Staggers, Swartzmiller, Talbott, Canterbury, C. Miller, Porter and Rowan offered the following resolution, which was read by its title and referred to the Committee on Rules:
H. C. R. 9 - "Requesting the Joint Committee on Government and Finance study means for municipalities to deal with uninhabitable and/or abandoned structures and properties in municipalities and develop workable procedures."
Whereas, Uninhabited and abandoned properties not only have negative aesthetic qualities, but they may be hazardous to the surrounding community; and
Whereas, The municipality may condemn and demolish the property, but it cannot obtain reimbursement for the demolition costs; and
Whereas, Allowing a municipality to sell the property to satisfy the lien and retain some of the money from the sale may be a means to help the municipality recover its costs; and
Whereas, Developing means for municipalities to deal with uninhabitable and abandoned structures and properties is in the best interest of the citizens of that municipality; and
Whereas, Rehabilitating abandoned or uninhabitable structures and properties will increase property values; and
Whereas, Increasing property value will help the state through increasing property taxes; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby requested to study means for municipalities to deal with uninhabitable and/or abandoned structures and properties in municipalities and develop workable procedures; and, be it
Further Resolved, That the Joint Committee on Government and Finance report to the Regular Session of the Legislature, 2009, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it
Further Resolved, That the expenses necessary to conduct the study, to prepare a report and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
Delegates Palumbo, Spencer, Wells, Guthrie, Hatfield, Brown and Higgins offered the following resolution, which was read by its title and referred to the Committee on Rules:
H. C. R. 10 - "Requesting the Division of Highways to name the Interstate 77 turnpike bridge crossing U.S. Route 61 near Turnpike Ford at Marmet the 'Captain Larry F. Lucas Memorial Bridge'."
Whereas, Captain Larry F. Lucas was a good, generous and honorable citizen born and raised in Marmet, West Virginia; and
Whereas, Captain Larry F. Lucas answered the call of duty and served his country faithfully, courageously and heroically in Vietnam; and
Whereas, Captain Larry F. Lucas distinguished himself by exceptionally valorous actions on the twentieth of December, nineteen hundred sixty-six, while serving as the flight leader of two aircraft during a reconnaissance mission over hostile territory; and
Whereas, Captain Lucas led the team to a suspected truck park and marshaling area and made the first photographing pass over the target alone; and
Whereas, Captain Lucas's plane received hits from hostile fire, but he was able to fly out of the danger area; and
Whereas, Gradually, one engine became useless and instruments indicated a fire in the plane; and
Whereas, Although Captain Lucas triggered automatic fire extinguishers, the pilot of the wing aircraft reported that Lucas's fuselage was burning from the wing to the tail assembly; and
Whereas, Nevertheless, Captain Lucas proceeded calmly toward the nearest airfield, or at least toward friendly territory; and
Whereas, Suddenly, the instruments behind Captain Lucas began sparking and the cockpit filled with flame and smoke; and
Whereas, Captain Lucas fought to maintain altitude as the aircraft settled into a thirty- degree dive, and ordered his co-pilot to eject; and
Whereas, Moments after the co-pilot left the cockpit, the aircraft pitched into a ninety- degree dive and crashed; and
Whereas, Captain Lucas's gallantry in action, at the cost of his life, was in keeping with the highest traditions of the military service and reflect great credit upon himself, his unit, and the United States Army; and
Whereas, Captain Lucas was posthumously awarded both the Air Medal (Second Oak Leaf Cluster) and the Silver Star; and
Whereas, It is a fitting and appropriate gesture to bestow a lasting memorial and tribute to honor this brave, honorable, selfless and patriotic native son, who gallantly went beyond the call of duty to save the life of his co-pilot - at the cost of his own - and to serve his country and his fellow citizens of Marmet, West Virginia; therefore, be it
Resolved by the Legislature of West Virginia:
That the Division of Highways is hereby requested to name the Interstate 77 turnpike bridge crossing U.S. Route 61 near Turnpike Ford at Marmet the "Captain Larry F. Lucas Memorial Bridge"; and, be it
Further Resolved, That the Commissioner of the Division of Highways is hereby requested to cause to be fabricated signs to read in prominent lettering: "The Captain Larry F. Lucas Memorial Bridge", which signs shall be erected at each entrance of the bridge, indicating that the bridge has been so named; and, be it
Further Resolved, That the Clerk of the House of Delegates forward a certified copy of this resolution to Larry F. Lucas's surviving nephew, David A. Holmes, who resides at 111 Spanish Oak Drive, in Culloden, West Virginia, 25510, to the Secretary of Transportation and to the Commissioner of the Division of Highways.

Delegates Cowles, Tansill, Canterbury, Rowan, Blair, Border, Walters and J. Miller offered the following resolution, which was read by its title and referred to the Committee on Rules:
H. C. R. 11 - "Requesting that the West Virginia Investment Management Board require divestiture of current investments in Iran, prohibit future investments in Iran, and prohibit West Virginia companies from operating in Iran."
Whereas, The United States, the State of West Virginia, and the international community face no greater threat to their security than the prospect of rogue regimes who support international terrorism obtaining weapons of mass destruction; and
Whereas, Iran is the leading state sponsor of international terrorism and is close to achieving nuclear weapons capability, but has paid no price for nearly twenty years of deception over its nuclear program. Foreign entities that have invested in Iran's energy sector, despite Iran's support of international terrorism and its nuclear program, have afforded Iran a free pass while many United States entities have unknowingly invested in those same foreign entities; and
Whereas, West Virginia investors have a great deal at stake in preventing Iran from acquiring nuclear weapons; and
Whereas, West Virginia investors can have considerable influence over the commercial decisions of the foreign entities in which they have invested; and
Whereas, It is in the best interest of the citizens of West Virginia to follow the lead of several other states and the United States Congress and divest itself of any dealings with Iran; therefore, be it
Resolved by the Legislature of West Virginia:
That the West Virginia Investment Management Board is hereby directed to disclose the state of investments in Iran, any involvement in Iran of any West Virginia companies, and develop a plan for divestment and removal from any involvement with Iran; and, be it
Further Resolved, That the West Virginia Investment Management Board shall publish a list of any such investment, the amount invested, and what necessary legislation if any will be necessary to effectively divest itself from such investments.

In Memoriam

Earlier in today's proceedings, Delegate Morgan addressed the House concerning the outstanding public service, dedication and political career of recently deceased Margarette Leach, former member of the House from the County of Cabell.
At the conclusion of the aforementioned remarks, the members stood in ovation to the memory of former Delegate Leach.
Whereupon,
Delegate DeLong then asked and obtained unanimous consent that the remarks of Delegate Morgan be printed in the Appendix to the Journal.
At 11:43 a.m., the House of Delegates adjourned until 11:00 a.m., Friday, January 18, 2008.
