Resolutions Introduced
Delegate Boggs offered the following resolution, which was read by its title and referred to
the Committee on Rules:
H. C. R. 105 - "Requesting that the bridge between mile markers 54 and 55 on Interstate 79
in Braxton County, West Virginia be named the 'Ray P. Reip Memorial Bridge'."
Whereas, Ray P. Reip was born in Braxton County, West Virginia in 1919 on his parent's
farm; and
Whereas, Ray Reip would walk several miles through countryside and then cross the Elk
River by boat to attend high school; and
Whereas, Ray Reip served in the United States Navy during World War II as an aviation
radioman, and, after his honorable discharge, Ray returned to his beloved farm in Braxton County
where he married his wife and had two daughters; and
Whereas, Following in his father's footsteps, Ray Reip was a farmer, that any neighbor
could rely on day or night for his help; and
Whereas, With the decision to build Interstate 79, Interstate 79 would transect Ray's farm,
taking his homestead, three barns, three ponds and land locking approximately 30 acres; and
Whereas, Ray worked hard to provide for his family, and always loved living in West
Virginia, which he truly believed was the next best place to Heaven; and
Whereas, Betty, Ray's surviving wife, served as a marine in World War II and is one of the
oldest female veterans of World War II in Braxton County, West Virginia; and
Whereas, Ray P. Reip was a wonderful husband, a loving father, a loyal neighbor, and
served his community unselfishly, his country with honor and distinction; therefore, be it
Resolved by the Legislature of West Virginia:
That the Division of Highways is hereby requested to name the the bridge between mile
markers 54 and 55 on Interstate 79 in Braxton County, West Virginia, the "Ray P. Reip Memorial
Bridge"; and, be it
Further Resolved, That the Commissioner of the Division of Highways is hereby requested
to erect signs at both ends of the bridge containing bold and prominent letters proclaiming the bridge
the "Ray P. Reip Memorial Bridge"; and, be it
Further Resolved, That the Clerk of the House of Delegates forward a certified copy of this
resolution to the Commissioner of the Division of Highways, Mr. Reip's wife, Betty Reip and his
two daughters, Barbara Morgan and Donna Pierson.
Delegate Boggs offered the following resolution, which was read by its title and referred to
the Committee on Rules:
H. C. R. 106 - "Requesting the Division of Highways to name bridge number 08-28-7.78 on
County Route 28 in Clay County, West Virginia, the "Staff Sergeant Arthur Coulter and Corporal
E. J. Sizemore Memorial Bridge."
Whereas, Staff Sergeant Arthur Coulter was born on September 9, 1949, and raised in Clay,
West Virginia; and
Whereas, Corporal E.J. Sizemore was born on March 28, 1939, and raised in Clay, West
Virginia; and
Whereas, Upon graduating from Clay County High School, Corporal E. J. Sizemore enlisted in the U.S. Army and served as an infantryman in the 101st Airborne Division, Screamin' Eagles; and
Whereas, Staff Sergeant Arthur Coulter enlisted in the West Virginia Air National Guard
on June 22, 1970; and
Whereas, Corporal E. J. Sizemore enlisted in the West Virginia Army National Guard on
January 26, 1974; and
Whereas, Staff Sergeant Arthur Coulter and Corporal E. J. Sizemore were both killed in
static line parachute accidents on September 20, 1975; and
Whereas, It is only fitting and proper that this bridge be named in their honor, and that it
henceforth stand as a permanent memorial so that Staff Sergeant Arthur Coulter and Corporal E. J.
Sizemore's supreme sacrifice will never be forgotten; therefore, be it
Resolved by the Legislature of West Virginia:
That the Division of Highways is hereby requested to name bridge number 08-28-7.78 on
County Route 28 in Clay County, West Virginia the "Staff Sergeant Arthur Coulter and Corporal E.
J. Sizemore Memorial Bridge"; and, be it
Further Resolved, That the Division of Highways is requested to have made and be placed,
signs identifying the bridge as the "Staff Sergeant Arthur Coulter and Corporal E. J. Sizemore
Memorial Bridge"; and, be it
Further Resolved, That the Clerk of the House of Delegates forward a certified copy of this
resolution to the families of Staff Sergeant Arthur Coulter and Corporal E. J. Sizemore and the
Secretary of the Department of Transportation.
Mr. Speaker, Mr. Thompson, and Delegate Armstead [By Request of the Executive], offered
the following resolution, which was read by its title as follows:
H. C. R. 107 - "Providing for the issuance of not to exceed $45 million of refunding bonds
pursuant to the 'Safe Roads Amendment of 1996', article two-g, chapter thirteen of the Code of West
Virginia and article twenty-six, chapter seventeen of said code."
Resolved by the Legislature of West Virginia:
That safe road refunding bonds in the principal amount not to exceed $45 million are
authorized to be issued by the State of West Virginia and sold by the Governor by the fiscal year
ending June 30, 2011; and, be it
Further Resolved, That the bonds shall be issued in registered form, in such denominations,
maturing at such times and bearing such date or dates as the Governor may determine; and, be it
Further Resolved, That all such bonds shall be payable at the Office of the Treasurer of the
State of West Virginia, or at a bank in the City of Charleston to be designated by the Governor; and,
be it
Further Resolved, That the bonds shall bear interest at rates and be payable in amounts as
determined by the Governor; and, be it
Further Resolved, That the State Treasurer shall pay the principal and/or interest then due
on the bonds to the registered owners thereon at the addresses shown by the record of registration;
and, be it
Further Resolved, That the bonds shall be signed as provided in section two, article twenty-
six, chapter seventeen of the Code of West Virginia; and, be it
Further Resolved, That the bonds may be redeemable on such date or dates prior to maturity
as determined by the Governor; and, be it
Further Resolved, That the Governor shall sell the bonds herein mentioned at such time or times in such amounts, not exceeding the aggregate principal amount described above, at such prices
as he may determine necessary to provide funds for the purposes provided below; and, be it
Further Resolved, That the net proceeds of sales of all bonds herein authorized shall be paid
into a special and irrevocable trust fund, separate and apart from other funds of the State of West
Virginia, to be held in the custody of an escrow trustee to be designated by the Governor; and, be it
Further Resolved, That an irrevocable deposit of said moneys in trust for, and such moneys
and the investments thereof, together with any income or interest earned thereon, shall be applied
to the payment of the principal of and interest on certain issued and outstanding safe road bonds, to
be selected by the Governor, as the same become due and payable.

Manchin, Michael, Ross, Schadler, Shook, Sobonya and Stephens.
So, a majority of the members present and voting having voted in the affirmative, the Speaker
declared the bill (S. B. 1003) passed.
Delegate Boggs moved that the bill take effect from its passage.
On this question, the yeas and nays were taken (Roll No. 456), and there were--yeas 86, nays
none, absent and not voting 14, with the absent and not voting being as follows:
Absent And Not Voting: Argento, Azinger, Cann, Caputo, Hartman, Hutchins, Mahan,
Manchin, Michael, Ross, Schadler, Shook, Sobonya and Stephens.
So, two thirds of the members elected to the House of Delegates having voted in the
affirmative, the Speaker declared the bill (S. B. 1003) takes effect from its passage.

At the request of Delegate Boggs, and by unanimous consent, the House of Delegates

Com. Sub. for H. B. 109 - "A Bill to amend the Code of West Virginia, 1931, as amended, by adding thereto a new article, designated §18-5D-1, §18-5D-2 and §18-5D-3, all relating to
collaborative team school-based decision-making; establishing purpose; school application to state
board to create teams; request to replace certain school-level committees; contents of application;
local level approval prior to submission of application; state board approval; state board waiver of
rules requiring certain school-level committees; exemptions granted to school from certain statutes
requiring school-level committees is requested in approved application; collaborative team
authorization to request waivers of state and county policies; and requiring state board rule,"
With the recommendation that the committee substitute do pass, and with the further
recommendation that reference of the bill to the Committee on Finance be dispensed with.
In the absence of objection, reference of the bill (Com. Sub. for H. B. 109) to the Committee
on Finance was dispensed with.

At the respective requests of Delegate Boggs, and by unanimous consent, reference of the
bill (S. B. 1024) to a committee was dispensed with, and it was taken up for immediate
consideration, read a first time and ordered to second reading.
A message from the Senate, by
The Clerk of the Senate, announced the passage by the Senate, to take effect from passage, and requested the concurrence of the House of Delegates in the passage, of
S. B. 1011 - "A Bill to amend the Code of West Virginia, 1931, as amended, by adding
thereto a new section, designated §33-2-23, relating to effectuating the federal Patient Protection and
Affordable Care Act of 2010; authorizing the Insurance Commissioner to apply for and expend
certain federal grants; authorizing the Insurance Commissioner to enter into contracts to implement
insurance programs authorized under the federal Patient Protection and Affordable Care Act of 2010;
exempting certain contracts from the state purchasing rules; authorizing the Insurance Commissioner
to designate a plan administrator; establishing a special revenue account in the State Treasury;
authorizing investment; and authorizing the Insurance Commissioner to promulgate emergency and
legislative rules to effectuate certain provisions of the federal Patient Protection and Affordable Care
Act of 2010."

bill (S. B. 1011) to a committee was dispensed with, and it was taken up for immediate
consideration, read a first time and ordered to second reading.
The bill was then referred to the Committee on the Judiciary.
