      Pursuant to the Proclamation of His Excellency, the Governor, issued the eighth day of January, 2022, convening the Legislature in Extraordinary Session assembled in its Chamber in the Capitol Building in the City of Charleston at 11:00 a.m., was called to order by the Speaker, the Honorable Roger Hanshaw.

      Prayer was offered and the House was led in recitation of the Pledge of Allegiance.

Dear Mr. Speaker:

With this letter, and a lot of pride in things accomplished during my tenure, I hereby resign my position as a member of the West Virginia House of Delegates.  It has been my honor, since my election in 2016, to serve as delegate to the 13th district.  From day one my goal has been to make West Virginia a place where young adults can find jobs that affords them a change to stay in West Virginia and raise their families.  While there is still more work to be done, I truly believe over the last six years West Virginia has made great progress toward that goal.

Please know my decision was not one made lightly but with much consideration for both those I represent as well as my personal future.  Recent changes in my life have led me to a move out of my current delegate district and into Kanawha County in the very near future.  Kanawha County has always been a special place to me that feels like home and a great place to start a family and raise children.

Thank you for the faith you showed in me during your tenure as Speaker including the appointment as Vice Chairman of House Education.  I will always be thankful for the opportunities afforded me during my tenure in the WV House of Delegates.

      Re: Resignation of Barry L. Bruce, Delegate 42nd District

Dear Honorable Speaker Hanshaw,

      It has been an honor and privilege of a lifetime to serve the 42nd District of Greenbrier, Summers, and Monroe Counties since being elected as their delegate in November 2020.  Serving as a member of the Republican Super Majority has been a blessing, and I am excited about the progress out state is making on the economic, social, and judicial fronts that were the hallmarks of my campaign.

      However, I am now facing health-related issues which will require surgical intervention(s) and a lengthy time of recovery, which will be during the upcoming 2022 legislative session.  Thus, effective December 4, 2021, I resign my position as Delegate from the 42nd House District of West Virginia, to assure my constituents full representation for the coming legislative session.  While I am saddened to leave office, I resign knowing my votes were made prayerfully and with the best interests of West Virginia and her people in mind.  I am thankful that I heeded God’s call to run for office and serve a state and region that has given so much to me.  I will continue to work behind the scenes for a better tomorrow for the Greenbrier Valley, and I will support whomever is appointed as my successor in any way possible.

      Thank you, Greenbrier, Summers, and Monroe Counties for allowing me to be your voice in ensuring that Mountaineers Are Always Free!

      Delegate Summers arose to suggest the absence of a quorum, the Clerk opened the machine for the roll to be taken (Roll No. 1), and 93 members being present, the Speaker declared the presence of a quorum.  The absent being as follows:

      Absent: Brown, Capito, Fluharty, Graves, Nestor, Phillips and Williams.

      Note:  Delegate Williams arrived later in the morning session and Delegates Capito and Fluharty were present in the evening session.

      On motion of Delegate Summers, the Speaker was authorized to appoint a committee of three to notify the Senate that the House of Delegates had assembled in extraordinary session and was ready to enter upon the business stated in the Proclamation by which it had been called together.

      Whereupon,

      The Speaker appointed as members of such committee:

      On motion of Delegate Summers, the Speaker was authorized to appoint a committee of three, to join with a similar committee on the part of the Senate, to inform His Excellency, the Governor, that the Legislature had assembled in extraordinary session and was ready to enter upon the business stated in the Proclamation.

SEVENTH: To authorize and appropriate public funds sufficient to pay for this Extraordinary Session.
