      The House of Delegates was called to order by the Honorable Roger Hanshaw, Speaker.

      Prayer was offered and the House was led in recitation of the Pledge of Allegiance.

      The Clerk proceeded to read the Journal of Wednesday, February 16, 2022, being the first order of business, when the further reading thereof was dispensed with and the same approved.

Reordering of the Calendar

      Pursuant to the action of the Committee on Rules, Delegate Summers announced that H. J. R. 102 on Third Reading, Special Calendar, had been transferred to the House Calendar; Com. Sub. for H. B. 2910 and H. B. 4331 on Second Reading, Special Calendar, had been moved to the House Calendar; H. B. 4627 on First Reading, Special Calendar, had been transferred to the House Calendar; H. Removal or Addition of Name as Sponsor of a Bill or Resolution

94b. Any Delegate whose name appears as a cosponsor joint sponsor of a bill or resolution may have his or her name removed as a sponsor of the bill or resolution by submitting a an written electronic request to the House Clerk via the delegate console not later than the day the bill or resolution is reported from its final committee: Provided, That the removal shall only be permitted if the member is not the last remaining sponsor of the bill or resolution.

Any Delegate wishing to be added as a cosponsor joint sponsor of a bill or resolution shall be added by the Clerk if written an electronic request is made to the Clerk via the delegate console not later than the day the bill or resolution is reported from its final committee. if the lead sponsor of the bill or resolution agrees in writing to the addition and if the bill has less than the maximum number of sponsors allowed by these rules

This amended rule shall not take effect earlier than the beginning of the 2023 Session and the completion of the update to the delegate console to support this amended rule. Nothing herein requires reprinting by the Clerk of paper copies of the bill to reflect the addition or removal of sponsors. Any such changes shall appear in electronic form only until reprinting of the bill is required by these rules.

Delegates Pinson and Hanshaw (Mr. Speaker) offered the following resolution, which was read by its title and referred to the Committee on Rules:

H. C. R. 79 - “Designating February 21 as the official start day to National FFA Week in West Virginia.”

Whereas, The National FFA (Future Farmers of America) Organization prepares students for future career and leadership success through agricultural education in middle and high schools; and

Whereas, The West Virginia membership of the FFA organization continues to be strongly represented by agriculture education students in 83 chapters throughout the state, with 4,778 members; and

Whereas, The motto of the FFA organization, “Learning to Do, Doing to Learn, Earning to Live, Living to Serve,” motivates members to be active members in their community, school, state, and nation; and

Whereas, The National FFA week is for students, educators, alumni, and supporters to celebrate the continual growth of the organization and its role in the development of the United States’ future leaders; and

Whereas, The West Virginia Legislature recognizes the importance of agriculture to the economy of this state, as well as the importance of the education and training students receive through agricultural education programs that develop competent and assertive agricultural leadership; and

Whereas, National FFA Week always runs Saturday to Saturday and encompasses February 22, George Washington’s birthday; therefore, be it

That the West Virginia Legislature declares that February 21 be the official start to National FFA Week in West Virginia; and, be it

H. C. R. 80 - “Declaring Blackwater Falls the official state waterfall.”

Whereas, Blackwater Falls is a waterfall located in Tucker County within the Blackwater Falls State Park; and

Whereas, The earliest written account of Blackwater Falls dates to 1746. Visitors have been drawn to the “great falls” of the Blackwater since the mid-1800s. In 1853, David Hunter Strother, also known by the pen name “Porte Crayon” introduced readers to Blackwater Falls in a series of articles in the Harpers New Monthly Magazine; In the 1870s, the area around the falls would become dotted with railroad lines to transport timber and coal to the neighboring towns of Davis and Thomas. The timber was nearly all taken from Blackwater Canyon and the soil was almost destroyed; and

Whereas, In 1937, the Blackwater State Park was created on 446 acres of land leased by the West Virginia Power and Transmission Company. Through the replanting of trees by the Civilian Conservation Corp (CCC) and continued expansion of land, the park has grown to 1,688 acres and offers more recreational opportunities; and

Whereas, The treasure of the park is the 57 foot waterfall, tinted by the tannic acid of fallen hemlock and red spruce needles. The falls is one of the most photographed views in West Virginia. Blackwater Falls is listed as number one on the Best Waterfall Trails in West Virginia, with 20 miles of hiking trails. The Blackwater Falls results from the Blackwater River, which is 35 miles long, running entirely in Tucker County. After it runs past Davis, West Virginia; it drops around 62 feet over Blackwater Falls and flows into the Blackwater Canyon in Blackwater State Falls State Park; and

Whereas, From a 2015 Economic Impact Executive Summary report, 855,085 people visited Blackwater Falls and provided an estimated contribution to the economy in the amount of $20,500,000; therefore, be it

Resolved by the Legislature of West Virginia:

That Blackwater Falls is hereby designated and declared to be the official state waterfall; and, be it

Whereas, Chief Warrant Officer Milford Arnold Cunningham was born February 4, 1931, at Prenter, West Virginia, and raised in Walton, Roane County, West Virginia. He preferred the name “Bill” to Milford; and

Whereas, Chief Warrant Officer “Bill” Arnold Cunningham enlisted in the United States Army, serving from 1948 to 1968. During his army career, he was stationed at Fort Belvoir, Virginia, and then served in Germany, Japan, Vietnam, and Korea. He was awarded three Purple Hearts; and

Whereas, Upon his retirement from active military duty, Bill Cunningham was transferred to the Kennedy Space Center (NASA) where he worked as a transport specialist moving the rockets from the hanger to the launch pad for all spacecraft; and

Whereas, Chief Warrant Officer Milford “Bill” Arnold Cunningham passed on February 11, 1998; and

Whereas, It is fitting that an enduring memorial be established to commemorate U. S. Army Chief Warrant Officer Milford Arnold Cunningham and his contributions to our state and country; therefore, be it

Whereas, Alleen Ledson was born on August 31, 1928, in Lenore, Mingo County; she was married for 69 years to Marion C. Ledson; together, she and her husband had seven children; and

Whereas, When Alleen Ledson was a young mother, she and other women on Laurel Creek beat up rocks and put them in holes in the road, which led to having a blacktop road on Laurel Creek; and

Whereas, Alleen Ledson enjoyed shopping with her four daughters and often prepared food for fish fries at Laurel Lake, welcoming all to come; and

Whereas, Alleen Ledson began working when her children were little, cleaning peoples’ houses, being a teacher’s aid at Laurel Grade School and started working for JCPenney in Williamson when she was 45 years old, where she worked for 21 years; and

Whereas, Alleen Ledson was a member of Bethany Church, often referred to as the “Old Regular Baptist Church”; and

Whereas, Alleen Ledson and her husband lived all of their lives together at the end of the bridge over Laurel Fork; and

Whereas, Alleen Ledson died April 30, 2015, after having faithfully served her family, her neighbors, her church, and her community at large virtually all of her life; and

Whereas, It is fitting that an enduring memorial in honor of Alleen Ledson be established near her lifelong home and community to commemorate her contributions to her family, church, and community, our state and country; therefore, be it

Resolved by the Legislature of West Virginia:

      Delegates Westfall and Williams moved to amend the bill on page one, immediately following the enacting section by inserting the following new section, to read as follows:

CHAPTER 38. LIENS.

ARTICLE 10. FEDERAL TAX LIENS; ORDERS AND DECREES IN BANKRUPTCY.

§38-10-4. Exemptions of property in bankruptcy proceedings.

Any person who files a petition under the federal bankruptcy law may exempt from property of the estate in a bankruptcy proceeding the following property:

(a) The debtor’s interest, not to exceed $35,000 in value, in real property or personal property that the debtor or a dependent of the debtor uses as a residence, in a cooperative that owns property that the debtor or a dependent of the debtor uses as a residence, or in a burial plot for the debtor or a dependent of the debtor: Provided, That when the debtor is a physician licensed to practice medicine in this state under §30-3-1 et seq. or §30-14-1 et seq. of this code, and has commenced a bankruptcy proceeding in part due to a verdict or judgment entered in a medical professional liability action, if the physician has current medical malpractice insurance in the amount of at least $1 million for each occurrence, the debtor physician’s interest that is exempt under this subdivision may exceed  $35,000 in value but may not exceed $250,000 per household.

(b) The debtor’s interest, not to exceed $7,500 in value, in one motor vehicle.

(c) The debtor’s interest, not to exceed $400 in value in any particular item, in household furnishings, household goods, wearing apparel, appliances, books, animals, crops, or musical instruments that are held primarily for the personal, family, or household use of the debtor or a dependent of the debtor: Provided, That the total amount of personal property exempted under this subdivision may not exceed $8,000.

(d) The debtor’s interest, not to exceed $1,000 in value, in jewelry held primarily for the personal, family, or household use of the debtor or a dependent of the debtor.

(e) The debtor’s interest, not to exceed in value $800 plus any unused amount of the exemption provided under subdivision (a) of this subsection in any property.

(f) The debtor’s interest, not to exceed $1,500 in value, in any implements, professional books, or tools of the trade of the debtor or the trade of a dependent of the debtor.

(g) Any unmeasured life insurance contract owned by the debtor, other than a credit life insurance contract.

(h) Any and all life insurance proceeds paid to the debtor as a beneficiary.

(i) The debtor’s interest, not to exceed in value $8,000 less any amount of property of the estate transferred in the manner specified in 11 U.S.C. § 542(d), in any accrued dividend or interest under, or loan value of, any unmeasured life insurance contract owned by the debtor under which the insured is the debtor or an individual of whom the debtor is a dependent.

(i) (j) Professionally prescribed health aids for the debtor or a dependent of the debtor.

(j) (k) The debtor’s right to receive:

(1) A Social Security benefit, unemployment compensation, or a local public assistance benefit;

(2) A veterans’ benefit;

(3) A disability, illness, or unemployment benefit;

(4) Alimony, support, or separate maintenance, to the extent reasonably necessary for the support of the debtor and any dependent of the debtor;

(5) A payment under a stock bonus, pension, profit sharing, annuity, or similar plan or contract on account of illness, disability, death, age, or length of service, to the extent reasonably necessary for the support of the debtor and any dependent of the debtor, and funds on deposit in an individual retirement account, including a simplified employee pension regardless of the amount of funds, unless:

(A) The plan or contract was established by or under the auspices of an insider that employed the debtor at the time the debtor’s rights under the plan or contract arose;

(B) The payment is on account of age or length of service;

(C) The plan or contract does not qualify under Section 401(a), 403(a), 403(b), 408, or 409 of the Internal Revenue Code of 1986; and

(D) With respect to an individual retirement account, including a simplified employee pension, the amount is subject to the excise tax on excess contributions under Section 4973 and/or Section 4979 of the Internal Revenue Code of 1986, or any successor provisions, regardless of whether the tax is paid.

(k) (l) The debtor’s right to receive or property that is traceable to:

(1) An award under a crime victim’s reparation law;

(2) A payment on account of the wrongful death of an individual of whom the debtor was a dependent, to the extent reasonably necessary for the support of the debtor and any dependent of the debtor;

(3) A payment under a life insurance contract that insured the life of an individual of whom the debtor was a dependent on the date of the individual’s death, to the extent reasonably necessary for the support of the debtor and any dependent of the debtor;

(4) A payment, not to exceed $15,000 on account of personal bodily injury, not including pain and suffering or compensation for actual pecuniary loss, of the debtor or an individual of whom the debtor is a dependent;

(5) (4) A payment in compensation of loss of future earnings of the debtor or an individual of whom the debtor is or was a dependent, to the extent reasonably necessary for the support of the debtor and any dependent of the debtor;

(6) (5) Payments made to the prepaid tuition trust fund or to the savings plan trust fund, including earnings, in accordance with §18-30-1 et seq. of this code on behalf of any beneficiary.

(l) (m) Solely for the purpose of applying the provisions of 11 U.S.C. § 522(b)(2) in a federal bankruptcy proceeding and only to the extent otherwise allowed by applicable federal law, an individual debtor domiciled in this state may exempt from property of the debtor’s bankruptcy estate the property specified under 11 U.S.C. § 522(d).

(m) (n) The amendments made to this section during the 2021 regular session of the Legislature, as amended during the first extraordinary session of the Legislature, 2021, shall apply to bankruptcies filed on or after the effective date of those amendments.

CHAPTER 46A. WEST VIRGINIA CONSUMER CREDIT AND PROTECTION ACT.
