Although the proposed legislation creates a new offense with a sentence of one to three years, it actually reduces the time until parole eligibility (from two years to one year) for those sentenced for DUI with Death. Therefore, the WVDOC estimates that there would be no significant fiscal impact from the passing of this legislation.
