Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
This legislation creates a prohibition on awarding contracts to state officials, family members, or vendors owned by state officials. Based on the definitions included in the language, the Purchasing Division would not have the ability to determine relationships with all vendors doing business with the state. However, the legislation requires that the vendor or prospective vendor signs an affidavit which would determine if there could be a possible violation to the newly created section of the W.Va. Code.
Because the affidavit would be required, there would not be a fiscal impact to the Purchasing Division to implement.

Memorandum
By having the Ethics Commission review any exemptions to this prohibition, there may be a delay in contract award and ultimately projects or programs needed by the state until the Ethics Commission makes their determination. Additionally, if lowest responsible bidder is disqualified for this prohibition, the Purchasing Division would have to go to the next highest bidder, resulting in a higher cost. However, the number of contracts that would be affected or the increased cost is not known.
