Effect this measure will have on costs and revenues of state government.


This proposed legislation is a result of a funded federal mandate contained within the federal transportation legislation Moving Ahead for Progress in the 21st Century (MAP-21). Federal Transit Administration (FTA) is providing $200,000 per year in federal funding to support this mandate. The Division of Public Transit (DPT) must match the federal funding at an 80/20 ratio. The $50,000 in state funding necessary for the match will be provided out of the existing budget of the DPT. Therefore, the proposed legislation will not have any effect on the present costs and revenues of state government.

Explanation of above estimates (including long-range effect):


The current Expenses will be used to match federal funding to hire a consultant to develop the FTA-mandated safety plan and provide inspection personnel to act for the State of West Virginia and perform all FTA required inspections.



Memorandum


49 U.S.C. Section 5329 (e) (3) states that if FTA cannot certify a State’s State Safety Oversight program no later than 3 years after the date of a final rule implementing 49 U.S.C. Section 5329 (e) (3), FTA is prohibited from providing any transit funding to the State or any public transportation agencies within the state. West Virginia receives approximately $24,000,000 in funding that would be withheld if compliance is not achieved. This proposed legislation is fundamental to West Virginia being able to implement a program that would comply with FTA’s requirements, thereby ensuring continued access to the $24,000,000 that sustains West Virginia’s transit organizations.
