Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to provide insurance coverage for abuse-deterrent opioid analgesic drugs. It provides that direct health care services cover abuse-deterrent opioid analgesic drugs while also providing certain contracts cover abuse-deterrent opioid analgesic drugs. It, additionally define applicable terms while providing an effective date. It further provides for cost sharing while providing for cost tier location and allowing cost containment measures.
The department does not anticipate a fiscal impact.

Memorandum
The proposed legislation does not specifically include the Medicaid program, and the code section modified with this legislation does not include Medicaid therefore it is not anticipated that the proposed changes will be required of the Medicaid program.
Medicaid drug copays are not structured around a Tier system as described in the proposed legislation. For Medicaid the cost of the drug is used to determine the applicable co-pay (lowest co-pay is $0.00, highest co-pay is $3.00). Medicaid MCO's follow the Medicaid co-pay structure. Medicaid uses a preferred drug list, and there is a covered preferred drug meeting the description of the proposed legislation for which the co-pay is $3.00.
