HB4622 would authorize county commissioners to conduct an option election on permitting licensed private clubs to sell beer, wine and other alcoholic drinks beginning at 10:30 am on Sunday and 7:00 am on other days and an option election on permitting private bed and breakfasts and wine restaurants and spas to sell wine beginning 10:30 am on Sunday. While allowing the sale of alcohol earlier may well increase sales and the taxes collected on those sales, the West Virginia State Treasurer's Office has no information that would assist the Legislature in determining the fiscal impact of HB4622. The Treasurer receives amounts collected by the State Tax Division on a quarterly basis, along with a report that lists the amount remitted to the Treasurer by political subdivisions (city/town/county) pursuant to the wine and liquor taxes and from private clubs. We have no way of knowing if an amount remitted is less than collected because of refunds from prior periods, etc. The State Tax Division may be able to research collections and determine the amount of any potential increase in tax collections. As to the cost of the option election, the Treasurer's office has no information on costs of prior elections. The West Virginia Secretary of State may be able to provide a cost estimate for the Legislature.
