The West Virginia Division of Corrections is unable to estimate how many new offenders would be sentenced to our custody as a result of the additional criminal penalties in this proposed legislation. However, for each such offender incarcerated, the State of West Virginia can expect an additional cost of $27,684 per year (average annual cost per offender in FY 2016). Please see below for technical concerns.

Memorandum


This bill requires that convicted sex offenders against minors who are on probation, parole or supervised release, would be placed on GPS monitoring for life. However, if the periods of supervision are not for life, the bill does not specify which agency would monitor the GPS system, their authority to do so, what would occur upon violations of the system, etc.
