Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to transfer administration of the West Virginia Traumatic Brain and Spinal Cord Injury Rehabilitation Fund to the Department of Health and Human Resources. This bill will transfers administrative responsibility and the costs for those responsibilities from Division of Rehabilitation Services to the Department of Health and Human Resources. There does not appear to be a current special revenue fund number established entitled "West Virginia Traumatic Brain and Spinal Cord Injury Rehabilitation Fund" pursuant to §9-10-2 (a) previously §18-10K-5. Ongoing funding for the Fund is subject to annual appropriation of funds by the legislature but is not mandated. Therefore, no funding currently exists in this account to transfer to the Department to support transfer of duties. General Revenue appropriation specific to this program Fund 0310 Appropriation 81300 ceased beginning in SFY2004. SFY2003 appropriation was $238,069. The Department estimates the fiscal impact relating to this bill to be approximately $71,940 per year. This amount is estimated based on the assumption that there will be no transfer of appropriated funding or resources from the Division of Rehabilitation Services.

Explanation of above estimates (including long-range effect):


The Department does not currently employ staff with experience in Spinal Cord Injury and thus would need to employ additional resources to adequately ensure the fund pays for services that will increase opportunities for and enhance the achievement of functional independence, and a return to a productive lifestyle for individuals who have suffered a traumatic brain injury or a spinal cord injury. Costs were determined to be $45,000 for one FTE HHR Program Manager 1 position with $15,940 for fringe and other benefits along with a small current expense budget for necessary supplies, travel costs and the annual meetings ($2,000 each) in the State's three congressional districts. It is expected that any other administrative efforts and costs that may arise can be absorbed by current funding/staffing within the Department.
