In order to reduce the Division's reliance on general revenue, this bill authorizes the Division to create special revenue funding sources to meet its mandated responsibilities. The Division estimates, upon full implementation in FY 2019, approximately $2.2 million in special revenue will be generated from registration fees for businesses that use weighing and measuring devices for commercial purposes, registration fees for service agencies and service technicians that work with commercial weighing and measuring devices, and registration and permit fees for manufacturers, upholsterers, renovators and sterilizers of bedding and upholstered products. The bedding sterilizer fees have not been increased since 1953. The registration fee for bedding manufacturers has not been increased since 1990. Almost all weights & measures programs rely solely on general revenue. Four (4) states surrounding West Virginia charge fees for the registration of service agencies and service technicians and thirty-four (34) states charge for the registration of devices used in commerce. The Division estimates there will be a phase-in period in FY 2018 during which the Division will need an estimated $675,000 in general revenue to operate these programs. The Division of Labor’s wage & hour programs do not have a revenue generating mechanism and will continue to need general revenue in the amount of approximately $500,000 to meet its mandated responsibilities.
