Effect this measure will have on costs and revenues of state government.


Each offender incarcerated for a felony against a child less than 16 years of age under the proposed legislation would result in an additional cost to the WV Division of Corrections of $52,162 ($26,081 average annual cost per offender in FY 2017 multiplied by 2 year minimum sentence). Each offender incarcerated for a felony against a child more than 16 years of age under the proposed legislation would result in an additional cost to the WV Division of Corrections of $26,081 (average annual cost per offender in FY 2017) due to a 1 year minimum sentence. However, the West Virginia Division of Corrections is unable to estimate how many new offenders would be sentenced to our custody as a result of the proposed legislation.
