Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to require a pharmacy benefit manager who contracts with the state to provide certain information to the state and to covered individuals. PEIA has reviewed this bill and determined there is no fiscal impact. PEIA, as the plan sponsor, currently receives such information as required by this bill. PEIA’s current pharmacy benefit manager (PBM) contract is a pass-through contract that disallows a difference between the amount charged PEIA for a prescription and the amount paid the pharmacy for the same prescription. PEIA would suggest that the reporting required by this bill be exempt from the freedom of information act (FOIA) due to proprietary data disclosure concerns. Although PEIA is currently in a pass-through PBM contract, and this bill is unnecessary at this time, PEIA would advise against any provisions that would prevent a spread contract in the event it is chosen to be more affordable in future PBM arrangements.
